In this case we will have informed you when we collected that data if we intend to share those data internally and combine it with data collected on this site, and told you for what purpose. We work closely with third parties (including business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and will notify you when we receive information about you from them and the purposes for which we intend to use it.

Cookies

Our website uses cookies to distinguish you from other users of our website. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site. For detailed information on the cookies we use and the purposes for which we use them, see our Cookie Policy.

We use information held about you in the following ways:

  • Information you give to us. We use this to carry out our obligations arising from any contracts entered into between you and us; to provide you with information, products and services that you request; to tell you about other goods and services we offer that are similar to those you've already purchased or enquired about; to provide you with information about goods or services we feel may interest you (we will only contact you by electronic means — email or SMS — if you have consented to this; you may withdraw your consent at any time by contacting us at Medway Cars Limited, 75 Stafford Street, Gillingham, Kent, ME7 5EN or info@medwaycars.co.uk); to notify you about changes to our service; and to ensure content from our site is presented in the most effective manner for you and your device.
  • Information we collect about you. We use this to administer our site and for internal operations (troubleshooting, data analysis, testing, research, statistical and survey purposes); to improve our site; to allow you to participate in interactive features when you choose to; to keep our site safe and secure; to measure the effectiveness of advertising we serve and to deliver relevant advertising; and to make suggestions and recommendations to you and other users about goods or services that may interest you.
  • Information we receive from other sources. We combine this with information you give us and information we collect about you, and use the combined information for the purposes set out above.

Disclosure of your information

We may share your personal information with:

  1. Any member of our group, meaning our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.
  2. Selected third parties, including: our business partners, suppliers and sub-contractors (AQL Text Credits, AutoTrader, Barclays, Bing, Book my Garage, Canddi, Chat Heroes, Click Desk, Codeweavers, Conflux, Contact at Once, CreditPlus, DealTrak, Evolution Funding Ltd, Good Garage Scheme, Google, Heart Internet, iVendi, Judge Service, Live Chat Inc, Live Help Now, MailChimp, Mandrill, Oodle Finance, PayPal, Review.io, Sage, Stripe, Trello, Trust Pilot, Twilio, UK Fast, Visitor Chat, WorldPay, Xero, Yell) where necessary for performance of any contract we enter into with you; analytics and search engine providers that help us improve and optimise our site; and credit reference agencies for assessing your credit score where this is a condition of us or our partners entering into a contract with you.

We will disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Medway Cars Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data to comply with any legal obligation, or to enforce or apply our Terms of Use or terms and conditions of supply and other agreements, or to protect the rights, property or safety of Medway Cars Limited, our customers or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction.

We will not disclose your personal information to third parties for their own marketing purposes unless we have your consent to do so.

Where we store your personal data

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using SSL technology. Where we have given you (or you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential and should not share it with anyone.

The data we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA") by one of our suppliers, and may be processed by staff operating outside the EEA who work for one of our suppliers — including staff engaged in fulfilment of your order, processing of your payment details, and provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure your data is treated securely and in accordance with this privacy policy.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Legitimate interests: the processing is necessary for our legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect the individual's personal data which overrides those legitimate interests.

For how long do we retain your personal data?

Unless required to do so by law (e.g. for preventing fraud or tax evasion), we do not retain personal data for longer than is necessary for the purposes for which we originally collected it. Ordinarily, this will be for a period of 7 years if you have purchased a vehicle or obtained finance through us, or 3 months if you have not. If you have not objected to us providing information about similar goods and services, or have given and not withdrawn consent for other marketing purposes, we will retain the data for as long as we need it for those purposes.

We regularly review the personal data we hold and delete anything we no longer need. Information that does not need to be accessed regularly, but which still needs to be retained, is safely archived or put offline.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will ask your consent (before collecting your data) if we intend to use it for such purposes or disclose it to a third party for such purposes.

You can exercise your right to prevent such processing by not checking certain boxes on the forms we use to collect your data. You also have the right to have inaccurate or incomplete data corrected and, in some cases, to have your personal data removed from our systems — for example where it is no longer necessary for the purposes it was collected for, where you have withdrawn consent, or where you object to the processing and there is no overriding legitimate interest for us to continue.

Where your personal data is processed by automated means based on your consent or for the performance of a contract, you may ask us to provide the data in a structured, commonly used, machine-readable form, or to transmit it directly to another organisation where technically feasible.

Unless the decision is necessary for entering into or performing a contract between us, is authorised by law, or you have given explicit consent, you have the right to ask us not to subject you to any decision which produces a legal or similarly significant effect based solely on automated processing.

You can exercise any of the above rights at any time by contacting us at Medway Cars Limited, 75 Stafford Street, Gillingham, Kent, ME7 5EN or info@medwaycars.co.uk.

Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that they have their own privacy policies and we do not accept any responsibility or liability for these policies. Please check these policies before submitting any personal data to those websites.

Access to information

The Act gives you the right to access information held about you. We will not charge you for providing details of the information we hold about you unless your request is manifestly unfounded or excessive, particularly if repetitive, in which case we will charge a reasonable fee based on the administrative cost of providing the information. We may also charge a reasonable fee to comply with multiple requests for further copies of the same information.

Changes to our privacy policy

Any changes we make to our privacy policy in future will be posted on this page and, where appropriate, notified to you by e-mail. Please check back frequently to see any updates.
